Urge your Senators to oppose efforts to attach anti-immigration measures to this must-pass bill. � Congress should stop playing politics with immigration and pass comprehensive immigration reform. These enforcement-only bills will do nothing to enhance border security and will not move us one inch closer to fixing our broken immigration system.
� Attaching these bills to DHS appropriations circumvents the legislative process on an issue of critical national importance; it undermines the intense and unflagging efforts of the Senate to solve this crisis; and it rewards the House for spending the summer attacking the Senate while abdicating its responsibility to the American people.
� Senators should forcefully oppose this effort by the House to nullify the Senate's bi-partison solution. If the Senate acquiesces on these provisions, the House will only be emboldened and will never return to debate comprehensive reform. � For laws to work, they must be realistic and fair. Our current immigration laws are neither: proposals like these that ignore the reality that immigrants come here to work and to be with their families are destined to fail.
� Giving the government unchecked powers to punish immigrants, and making local police chase after immigrants, will only drive undocumented immigrants further underground. It will not fix the problem; it will make matters worse.
We called you to action last week to alert you to an underhanded political strategy from immigration restrictionists to attach three enforcement-only bills to the DHS appropriations bill, a bill that must pass this year. You and your colleagues sent close to 2,000 letters to Congress, but we'll need more letters and phone calls in order to ensure that Senate Appropriators exclude these measures from the bill.
Leaders of the U.S. House of Representatives are working behind closed doors and using procedural mechanisms to attach enforcement-only provisions contained in three bills (H.R. 6094, H.R. 6095, and H.R. 4830) to the Department of Homeland Security appropriations bill, a piece of legislation that must pass this year. Although House leaders label these bills "border security" legislation, they are in fact harsh enforcement measures lifted from Rep. Sensenbrenner's H.R. 4437 that endanger due process rights and do little to make our borders more secure. You can find general information about the three bills below and a section-by-section analysis of each one on InfoNet.
If these provisions are attached to the must-pass DHS bill, it will be nearly impossible to defeat them. Our best defense against this backdoor strategy is to put pressure on each U.S. Senator and encourage them to oppose any attempt to attach, or further these three enforcement-only bills. We're working hard in Washington to derail these political machinations, but we can't do it alone. We need your help. Please email or call both of your Senators today.

While they kept the media busy and their restrictionist base roiled, they failed to change the minds of the majority of Americans who support a comprehensive solution to our broken immigration system. Nor did they succeed in backing down the U.S. Senators who supported S. 2611, a strong step towards comprehensive immigration reform. Now that House leaders know that the full Senate won't pass their enforcement-only agenda, they have resorted to closed-door politicking. We must fight to prevent the breach of justice that would result from attaching these enforcement-only bills to must-pass legislation.

� Sections 101 and 102 of the Dangerous Alien Detention Act contained in H.R. 6094, which seek to legitimize the practice of indefinite detention of aliens awaiting removal, despite Supreme Court decisions requiring elimination of this practice;
� Section 201 of the Criminal Alien Removal Act contained in H.R. 6094, which would expand the use of expedited removal proceedings to individuals already in the United States - even individuals who have resided here for years - in ways that would significantly increase the risk of deporting innocent people;
� Sections 301-303 of the Alien Gang Removal Act contained in H.R. 6094, which would grant unfettered discretion to the executive branch to designate "criminal street gangs" and then strip members of such gangs of virtually all rights;

I have my first GC interview next month. I had a DUI few years back that I forgot to mention in the 485 app as I thought this was a traffic related offense. I want to know what are my options now? My lawyer suggests I file for some kind of waiver and suggests I take an attorney with me to the interview. She also asked me to get court certified copies of the conviction and that I completed all the required tasks assigned by the court.
Is this going to affect my GC in anyway? I need some guidance here.

It�s been long since I got head ache..but today I had every reason to get.
I tried taking an appointment for h1B for December. Here is my experience�
1. After entering the receipt details it took me to available dates calendar. In this screen there was no option to pick an specific date for appointment. This screen was same as the screen we get when we check for available date without entering receipt number.
2. I pressed �Continue� and it later took me to DS156.
3. Filled the form and it took me to screen which displayed my name against a check box with 3 option. The screen says..�select the form to edit/complete..� 3 options I can see are DS156,DS157 and petition details. No matter how many times I edit the information I can�t get the choice to pick the appointment date. Basically I have filled up the form without knowing the appointment date.
4. If I try to download the appointment letter it says..�You cannot download until you specify courier address��.
Has anyone experience similar problem�?? Any work around�.??
Any help is greatly appreciated�thanks in advance�

I had absolutely no problems, it's all smooth as long as you carry all the supporting docs. I did have a shitty experience at JFK -- there are few morons at the POE you can't do much about.

Whatever my Lawyer has done , has not worked so far, I guess he sent copies of both I140's and a letter requesting to use the EB3 PD with the EB2 case.
My lawyer also done the same thing. However, TSC sent a reply back saying contact National Service Center.

Folks,
We need to understand that we have chosen a tough but worthy effort in the form of this forum. As such it may be depressing to see the slow movement in DC.
We should not be setting ourselves some timelines like the ones stated in this email thread, and then feel depressed about seeing no positive results within that timeline...there are too many factors outside our control to do anything like that...
I think we are better off than we where we were last year, when the awareness was nil, and that backlog legislation only favored the RNs and the PTs, while we saw ourselves powerless...
Lets help the core team..and not get depressed over short timelines...I see light at the end of our efforts...may not be phenomenal..but I am sure it will make a difference...for each of us...

Mr Desi - Here is my take on this. Most 485 questions will come up at the time of applying Visa stamp. The consulates dont like the fact that you filed 485.
However, since you have done it legally (like everyone else), my take is that, canadian consulates are more likely to NOT make an issue out of it, unlike Indian consulates. However as always an element of risk is there. Indian consulates are very high risk when you have filed 485.
In case of port of entry, I recently entered US on H1 visa despite having 485 and AP. My wife used her AP at the same time of entry together with me. The officer asked me, "why dont you also use your AP?" I said, I have AP, but I want to use H1 visa if possible. And he said, ok, no problem, its your wish.
So again, depends on the officer you bump into. Both me an my wife had no issue at POE.
However, Mumbai consulate issued her 221(g) for some inexplicable reason.

My wife wants to move from h1b to h4 status.
Her H1b has started on Oct 1st 2008, and since then her employeer has not found any project and he is not running any her payroll till now.
What is the procedure to come back to H4.
She already has H4 Stamping valid in her passport (until August 2009).
She does not have H1B Stamping on her passport.
My H1B status is perfect with all paystubs.
Her lawyers are suggesting her to go out of country and come back on her H4 Stamping.
I am afraid if any one would ask her about her H1B Paystubs on her arrival back into USA.
Would there be any problem in coming back on H4?

Immigration in United States is a soveriegn issue of this country and foriegn governments cannot do anything about it. In fact, it would be offensive for Indian Govt to advice US congress to do something regarding immigration.
Kamalnath, India's commerce minister tried to meddle in British Parliament when they changed visa rules for Indian Doctors. The British Parliament warned him and asked him to BACK OFF.
Immigration is not a trade issue. There is not deal between 2 nations on immigration. We are not talking about crude oil or soybeans trading.
Please end this discussion here. It looks really naive of us to even think like this.

I came back to US on Mar 30 2008 using advance parole. The officer wrote on I-94 , paroled until Mar 29, 2008 (I am assuming its an oversight).
I didnt detect the oversight till yesterday. What my current status and what actions should I take to rectify the error.
I am still working for my employer that sponsored the H1B which is valid till Feb 2009, although the stamp on the passport was valid only till Feb 2008

initially I was mad, becasue I remembered the revised July 2007 visa bulletin that came out declaring a reversal. Since NSC is going slow, I thought that DOS has once again pulled back on the dates. Later on I realized that its a mistake by the thread owner and got pissed off, and finally all I can do is laugh on the entire brohaha. Does the 45 day limit on being able to use a LC mean that priority dates from an approved LC and I-140 can no longer be ported when the GC process is started again through a new employer ?

We are apply independently since both of us are in H1B status
I presume that this marriage in foreign country may not be valid because the marriage was neither registered in India nor done according to Foreign Marriage Act, 1969, since both of us are citizen of India at this present time.

Also, if getting married is important to you, your partner, and you are sure about your relationship, and if you guys are getting it done in India anyways, why not get a court marriage here ASAP before filing for your I-485.
From a GC perspective, it "might" be better to have one I-485 application with spouse as the beneficiary rather than pursuing two I-485s independently.

Can anyone suggest me a good health insurance policy for the state of TN? What are the things that are important and what should be ignored? Most of the time I dont understand the technical terms used in it.
Currently I have one from a big health insurance company bought on the internet. I thought I was covered well. Every year they are raising the premium by about $30.00/month. I want to get another one, if anyone has bought from the open market please let me know.

My H1-B extension was filed on June 3 2010 requesting for additional 3 years (after the 1st 6 yrs). My labor and I-140 were also approved. The case has been pending since then. It has been more than 5 months now. I was wondering if anyone else is experiencing similar delays? My I-797 has expired in September and I'm still working on the basis of the pending application.
