Great news. Now if only they'd kept Rosetta, I'd upgrade happily. As it is... I'm going to have to stay stuck in Snow Leopard.

    why?

Apple Gets French Support in Music Compatibility Case

    By THOMAS CRAMPTON
    Published: July 29, 2006

PARIS, July 28 The French constitutional council, the countrys highest judicial body, has declared major aspects of the so-called iPod law unconstitutional, undermining some controversial aspects of the legislation.

Apples lawyers might want to drink a glass of French Champagne today, but not a whole bottle, said Dominique Menard, partner at the Lovells law firm and a specialist in intellectual property. The constitutional council has highlighted fundamental protections for intellectual property in such a way as to put iTunes a little further from risk of the French law.

Released late Thursday, the councils 12-page legal finding made frequent reference to the 1789 Declaration on Human Rights and concluded that the law violated the constitutional protections of property.

The decision affects Apples market-dominant iTunes Music Store by undermining the governments original intention, which was to force Apple and others to sell music online that would be playable on any device. Apples iPod is the only portable music device that can play music purchased on iTunes, which lead rivals to complain about anti-competitive practices.

Although the ruling could still require companies like Apple to make music sold online to be compatible with other hand-held devices, it said that the companies could not be forced to do so without receiving compensation. The council also eliminated reduced fines for file sharing.

The constitutional council effectively highlighted the importance of intellectual property rights, Mr. Menard said, emphasizing that Apple and other companies must be paid for sharing their copy-protection technology.

The law, which had been approved by the French Senate and National Assembly last month, was brought for review at the demand of more than 100 members of the National Assembly. The councils review of whether the law fits within the French Constitutions framework is one of the final steps before a law is promulgated. It now could take effect as altered by the council or the government could bring it once more before the Parliament.

The French minister of culture, Renaud Donnedieu de Vabres, advocated enforced interoperability as a way to ensure diverse cultural offerings on the Internet by limiting technical constraints on digital works.

While the constitutional council highlighted the need for compensation, it was not such good news for Apple and other companies that the principle of forced interoperability remained in place, said Jean-Baptiste Soufron, legal director of the Association of Audionautes, a group opposed to copy restrictions.

It is good news for Apple because they receive monetary compensation, but much bigger bad news if it forces them to license iTunes, he said. Link (requires login) (http://www.nytimes.com/2006/07/29/technology/29music.html?_r=4&ref=business&oref=slogin&oref=slogin&oref=login&oref=slogin)

hate to ask a stupid, perhaps already answered a gagillion times, question but

is there a live feed of today's proceedings?

No, we will be able to watch it from Apple's website later in the day. Macrumorslive will be providing live text updates.

Once I went to Best Buy to get a toslink cable with a mini plug end for my macbook. The employee in the department asked if I needed help. I responded that I need a toslink cable with a miniplug end rather than the regular. The employee in charge of the cable section had never heard of such a thing. I described it but the employee had this look that suggested I was confused. LOL

Local retail would be worth a little extra cost if employees were actually trained to be knowledgable in the products. That would require paying decent wages to knowledgable staff. Sadly the retail outlets like to charge more and pay minimum wage to people who are expected to know the location of items on shelves and that's it. Most of the employees in Best Buy that I've encountered could have been replaced with grocery store clerks and the service would be the same. I'm not insulting the workers. Just pointing out the expectations of the clerks in these places. And of course if you want employees to be interested in the product line more, they should be paid more.

Everyone is making comments that suggest that the Gizmodo guys are professionals and have broken some code of ethics.
They were there as professionals at a professional event, and as said, given press passes. They presented themselves as professionals, and wouldn't have gotten in for free and to the presentations had they not. Even worse, they bring the rest of the community down with them. Some bloggers actually fight hard to try and be taken seriously. Stuff like this just makes it harder for them. And since they're making money by covering this, they may get a small bump in the short term, but it could hurt them down the line when companies decide they aren't worth doing business with.

    Statement from the CEA (http://www.news.com/8301-10784_3-9849168-7.html?tag=nefd.only):

We have been informed of inappropriate behavior on the show floor by a credentialed media attendee from the Web site Gizmodo, owned by Gawker Media. Specifically, the Gizmodo staffer interfered with the exhibitor booth operations of numerous companies, including disrupting at least one press event. The Gizmodo staffer violated the terms of CES media credentials and caused harm to CES exhibitors. This Gizmodo staffer has been identified and will be barred from attending any future CES events. Additional sanctions against Gizmodo and Gawker Media are under discussion.
It's not quite as funny when there are consequences.

So... what are we supposed to run this monstrosity on? The G5 QUADS had a hard enough time running the first one. I can't imagine running this on an iMac or worse... a mac mini.

    JOKE JOKE JOKE

I run Aperture on a 20" G5 iMac. I know people running on Dual Quad G5s that love it. You either don't run this software or have some serious issue w/ you Mac.

WTF is wrong with Ohio? WTF is wrong with Republicans? Hey Republicans, guess what? You're signing your political death warrants, and you're going to contnue to drive jobs and people from Ohio.

Folks in Ohio, get off your butts and fight this!

BOWLING GREEN, OHIO -- The battle over a bill that some claim ties the hands of unionized public workers in Ohio has spread to the campus of Bowling Green State University.

Members of the BGSU community held a walkout Thursday afternoon in opposition to Senate Bill 5.

On Wednesday, the Republican-controlled Ohio Senate has passed the measure that would restrict the collective bargaining rights of roughly 350,000 teachers, university professors, firefighters, police officers and other public employees.

The measure now goes to the state House, where the GOP holds a 59-40 majority.

Republican Gov. John Kasich has said he supports the effort.

Protestors at BGSU on Thursday said it's not fair to restrict the rights of union workers. The group said it supports their right to free speech as they gathered on campus in opposition.

The bill establishes fines and jail time for those who participate in strikes. Unionized workers could negotiate wages, hours and certain work conditions - but not health care, sick time or pension benefits.

Republicans have argued that the bill reigns in unions, which they believe make it difficult to balance the state's budget.

Ohio currently faces an $8 billion two-year budget shortfall.

It is a shame...so difficult to create a reputation as a blogger then they do this...

If one headless guy chose to do that, then it was GIZMODOs responsability to deal with him, not to endorse him by exposing this stupidity on their site.

This is news media after all, not the Borat show.

Personally, I find the comparisons of teachers' pay with an 'average private sector employee's pay' downright useless. You're not comparing apples to apples. Do they have the same degree? Is there the same demand/supply of employees? Teachers aren't making 'too much' (compensation should be based on quality of work, value added to society, supply/demand, etc.)... some are making too much, some are making too little. The problem is that its'a an idiotic one-size-fits-all system in which many of them feel 'entitled' to their jobs, entitled to their benefits, entitled to their unions, entitled to their collective bargaining, entitled to their tenure. It's BS. You aren't entitled to anything except for compensation based on how well you do your job.

SJ announced 4 m iPhones sold. I believe I read some days ago that 5 m have been expected??
Maybe I'm wrong. But if not, we learned today that iPhone and Apple TV aren't doing well. Apple should refocus on their core business before to many Mac customers leave disappointed.

The reasons people HATE this new version so much:

    1. It adds a lot of features and answers requests.

    2. It's a free update.

    3. This is a photography event, and people were caught off guard when Apple showed their photography product, despite the Aperture image right on the invitation.

    4. Apple never releases hardware on Tuesdays, so there is no hope for any MacBook Pro updates tomorrow.

    5. There will never be another chance for new MacBook Pros. We now know that the current models will be sold forever and ever, even after Apple goes out of business, which will happen by the end of the year.

    :p

    This is a FANTASTIC post.
