Hello,

To issue an Individual Taxpayer Identification Number (ITIN) for an H4 visa holder, the local IRS office is asking Indian passport and Indian birth certificate. It is difficult to get birth certificate in India because the birth was never registered. Is it OK to submit the affidavit given by parents (the kind usually used for immigration needs), instead of the birth certificate, to get the ITIN number. If anyone got their ITIN number by using such affidavit given by parents, please post your reply. Thanks in advance.

What is the significance of birth certificate?

I only had to send in notarized passport copy to get ITIN. For foreign nationals, passport is more than enough.

Has anyone tried using the multiple mask technique to expand dept of field rather than (or in addition to) dynamic range? Might have to soften the edge of the mask but in principle it should work, using one photo set to near focus and the other to infinity. Obvioiusly a tripod would be essential. For non-manual focus lenses one could toggle the infinity focus on/off.

Come on guys, we are in US not in Saudi Arabia. Such comments are made in US senate also. It's not illegal to say something like that. It was a good joke. With all due respect let me ask you, are "Highly skilled" not human being?

Still I agree that such comments should not be made, because it could become a norm, and someone someday could really cross the boundry, which could create a problem for IV.

You can do a lot in this instance with a single well-exposed (highlights to the right, but not blown out) RAW file from a low-noise camera (e.g. anything but my D1). ;)

What you must do is to go through the RAW conversion process twice, making two files: one with the highlights placed where you want them (don't worry about the shadows), and another with the shadows brought up to the level that you'd like (the highlights will be blown out in this image). Now, stack the two in one image as two layers, and use a layer mask on the upper image to "paint" where the bottom one should show through.

This is explained in a tutorial (http://www.luminous-landscape.com/tutorials/blended_exposures.shtml) over at the Luminous Landscape. Given that he was using film when he wrote that, he included a bit on aligning the two images, which you won't need to worry about because both of your images came from the same photo. If you have any more questions, I'd be glad to help, or I'm sure one of our other members who's forgotten more about Photoshop than I'll ever know could help you even better. :)

Edit: $#%^, Gary beat me to it with the LL tutorial. Nevertheless, double RAW conversion works well [not quite, but good enough if you can't go back to do it again] with the same method outlined therein.

Thanks guys for all your replies & suggestions. Just to let you know, that I am paying for my whole GC process and I have been with this company since last 3 years. I have already completed one 2 year contract term with them and still they are asking me to sign new contract. To me, this is total blackmailing.

you will get "12/28/2007"

So lets say Jan 1st to be on safe side, so this new year eve we can celebrate our independence from H1b employer. I marked on my calendar Independence day for me and lot of IV friends.

Yes you need the I-94 attached with I-797 in order to apply for change of status (H1 to H4). your employer can not keep I-797. Just tell your employer that you need to apply SSN and you need I-797.
Thanks! But if I apply for my own H4, I would require my copy of I797 and the I94 attached to that. My employer doesnt provide me with the copy of those. Would the documents from my husband good enough to apply in US?

Here are the steps in setting up "Bill Pay" from your Bank account (online)

1) Check with your bank if "Bill Pay" is a free service, or not for your account. Some banks have conditions that must be met for e.g. Direct Deposit, Certain minimum balance, certain type of account or not. If you don't meet the criteria your bank may charge a service fees for using "Bill Pay"!

2) You might need to get "Bill Pay" activated on your online account. This might be possible for some by clicking on a "Service Agreement" screen. For others you might need to visit the Bank to get it activated.

3) Most banks that support "Repeating payments" allow you to "Add Payee" for future transactions. Provide IV address here and add "Immigration Voice" as a payee

4) Click on link that says "Setup Repeating Payments" in the "Bill Pay" section (some might provide this option while setting up payments and not provide a separate section)

Select "Immigration Voice" as the payee. Enter the amount you would like to send to IV every month. Select the frequency as "Monthly" ( there may be other options such as daily, bimonthly, annually, quarterly etc. choose the one suitable for you.)

In the "message to payee" (or something similar) provide your E-mail id. This will be used by IV to inform you of check enchashment (thank you note). Will help you track the payment end-to-end.

6) Bank account (Bill pay section) will give you a list of all checks sent to IV (from the Bank). If any check hasn't been acknowledged, call IV and make sure it's been received!

The worst hit 140's are EB3 (and that too mostly in NSC and some in TSC). Not a single NSC EB3-140 is coming at < 400 days.

EB2 is coming still okay and EB1/EB2-NIW are pretty quick. So i dont see a good quantity of benefit by allowing Premium Processing only on a thin section of applications ?? It make a difference of few days, not even months.

Where they need to re-instate Premium 140 to give actual relief - they wont do anything.

And not all EB applicants have labor. EB1 and EB2-NIW have no labor. Such applicants would benefit greatly from this rule since USCIS is taking a ridiculous amount of time to adjudicate I-140's.

Stayed in the US for a dozen years, got my masters, worked at a Fortune 10 company for several years, finished my 40 social security credits, always thought about coming back home (India), did actually come back to India 1.5+ years ago, left all uncertainties about the US immigration process behind, accepted a good job (big fish, not-so-small pond in my hometown) and accepted India as it is.

So, for those who have been waiting patiently for their papers and want to settle in the US, all the very best.

For those, who want to come back to India to their friends and family, India *is* still !ncredible.

Thanks for your reply. The consulting firm is saying that they have sent it to DOL before July 15 and are waiting for the reply for the Substitution( I really doubt the legality of that statement). In case if there is a provision then How can we check the status of it?

MY friend has to bear the expenditure for the I140. He just came back to US after 5 months and would like to know weather he can spend 1500$ on this unrealistic Labor.

The law says (8 USC 1154):
"(j) Job flexibility for long delayed applicants for adjustment of status to permanent residence
A petition under subsection (a)(1)(D) of this section for an individual whose application for adjustment of status pursuant to section 1255 of this title has been filed and remained unadjudicated for 180 days or more shall remain valid with respect to a new job if the individual changes jobs or employers if the new job is in the same or a similar occupational classification as the job for which the petition was filed."

Can you be more specific. In India you have 3 year diploma and then 4 year BE. The 4 year BE is same as 4 year BS here, plus the MS puts you in form for an EB2 category if the job requires a MS.

I was reading at some of the posts in this forum and they seem to have been quiet helpful.

My company has decided to go ahead with my GC process.
Its in the very early stage, but my immigration specialist gave me a heads up regarding something.

She said, that as I have a 3 yrs BE degree the USCIS may not recognize me under EB2 category :confused: So I explained her the education system in India, but she said that it depends upon the Credential Evaluation Agency which will process my educational qualification and prepare a report and submit it to USCIS.
Following this USCIS will make a decision whether to grant EB2 or EB3 category.

I am sure many of the members may have faced a similar Dilemma....Is there any specific solution to this?

To be precise I completed my Diploma from Mumbai & Degree from Pune University, followed by MS in US and currently working on H1B.

Please Advice.

US Laws protect employees completely.

If at all your current employer wants to do anything they can sue your new H1 sponsor or the end client. If your end client and new employer's attorneys are ok to sponsor H1 and job contract, then you don't have to worry.

3 years before I wanted to join my then end client directly. But their vendor manager refused becos they had signed an agreement with my then employer stating that they will not hire any resource for 6 months from the date they leave the work.

#1. Usually duration, designation and salary to be provided by company.

#2. The role or work related description can be provided by co-worker.

If RFE is related to #1, and company is closed, then lawyer (or yourself) has to present your case with whatever evidences are there (e.g. company is closed, follow up with ex-management to get certificates, etc).
